Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of the Seaside Imagery website and your purchase or use of services provided by Seaside Imagery (“Seaside Imagery,” “we,” “us,” or “our”).

By using our website, submitting a booking request, or engaging our services, you agree to these Terms.

If you do not agree with these Terms, please do not use our website or services.

1. Our Services

Seaside Imagery provides professional real estate and property media services, which may include:

  • Real estate photography
  • Real estate video
  • Aerial and drone photography or video
  • Twilight photography
  • Matterport and other 3D virtual tours
  • Zillow 3D tours
  • Vacation rental photography
  • Property media and related visual content

The specific services, deliverables, pricing, turnaround times, and other details applicable to an individual booking may be provided during the booking process or in a separate agreement, proposal, invoice, or order confirmation.

2. Booking and Scheduling

Appointments are subject to availability.

When submitting a booking request, you agree to provide accurate and complete information, including the property address, requested services, preferred date and time, and any other information reasonably necessary to complete the booking.

A booking is not necessarily confirmed until Seaside Imagery confirms the appointment.

We may contact you by phone, text message, email, or another communication method you provide to confirm or clarify appointment details.

3. Property Access and Preparation

The client is responsible for ensuring that the property is accessible at the scheduled time and is reasonably prepared for photography or other requested services.

Unless otherwise agreed, Seaside Imagery is not responsible for preparing, cleaning, staging, repairing, or otherwise altering a property before a shoot.

The client should ensure that:

  • The property is accessible at the scheduled time
  • Required areas are accessible
  • Pets and other animals are secured when appropriate
  • Personal or sensitive items are removed or secured as desired
  • The property is reasonably prepared for photography
  • Any necessary permission to photograph or access the property has been obtained

Delays caused by lack of access, inadequate preparation, occupants, contractors, pets, or other circumstances outside Seaside Imagery’s reasonable control may affect the shoot or delivery schedule.

4. Client Responsibility and Authorization

The person booking our services represents that they have the authority to authorize photography, video, drone operations, and other requested media services at the property.

The client is responsible for obtaining any permissions, releases, approvals, or authorizations required from property owners, occupants, tenants, homeowners’ associations, property managers, or other relevant parties.

5. Weather and Safety

Outdoor, aerial, and drone services may be affected by weather, visibility, wind, precipitation, airspace restrictions, or other safety conditions.

Seaside Imagery may postpone, reschedule, modify, or cancel an outdoor or aerial portion of a shoot when conditions are unsafe or when required by applicable rules or regulations.

Any rescheduling will be coordinated with the client when reasonably possible.

6. Turnaround and Delivery

Estimated delivery times may vary depending on the services ordered, project requirements, editing requirements, volume of media, technical issues, or circumstances outside our reasonable control.

Where a specific turnaround time has been agreed upon for a booking, that timeframe will apply subject to the terms of the applicable booking or agreement.

Completed media may be delivered electronically through email, download links, client portals, cloud services, or other delivery methods selected by Seaside Imagery.

7. Editing and Creative Judgment

Photography and video services include professional editing according to Seaside Imagery’s normal workflow and creative standards.

Editing may include adjustments to exposure, color, contrast, lighting, cropping, perspective, and other visual elements.

Specific editing requests may be subject to additional charges or may not be possible depending on the nature of the request.

Unless otherwise agreed in writing, Seaside Imagery retains reasonable creative discretion over the final presentation of the media.

8. Media Usage and License

Unless otherwise stated in writing, clients receive a license to use the final delivered media for the marketing and promotion of the property or listing for which the media was created.

The client may use delivered media for purposes such as:

  • MLS listings
  • Brokerage websites
  • Property websites
  • Social media
  • Digital advertising
  • Print marketing
  • Email marketing
  • Other normal property marketing purposes

The client may not sell, sublicense, transfer, or commercially redistribute the media to unrelated third parties unless permitted by Seaside Imagery in writing.

Raw files, unedited files, project files, and source materials are not included unless specifically agreed in writing.

9. Photographer’s Copyright and Portfolio Use

Unless otherwise agreed in writing, Seaside Imagery retains copyright and ownership of the original photographic and video works created as part of its services.

Seaside Imagery may use completed media for its portfolio, website, social media, advertising, promotional materials, case studies, and other business-related purposes, unless a separate written agreement provides otherwise.

If a client requires confidential treatment or does not want particular media used for promotional purposes, the client should discuss this with Seaside Imagery before the shoot or enter into a written agreement addressing the restriction.

10. Third-Party Platforms

Certain services may involve third-party platforms, including booking systems, client portals, MLS platforms, Zillow, Matterport, social media platforms, or other services.

Seaside Imagery is not responsible for changes, outages, restrictions, policies, or technical issues caused by third-party platforms.

Use of those platforms may also be subject to their own terms and policies.

11. Payment

Payment terms, service pricing, deposits, balances, and applicable fees will be communicated during the booking process or in the applicable invoice, proposal, or service agreement.

Unless otherwise agreed in writing, payment obligations remain the responsibility of the person or entity placing the order.

Additional services or changes requested after booking may result in additional charges.

12. Cancellation and Rescheduling

Cancellation and rescheduling policies may vary depending on the service booked and may be stated in the applicable booking confirmation, invoice, proposal, or service agreement.

Clients should contact Seaside Imagery as soon as possible if they need to cancel or reschedule an appointment.

Weather-related cancellations, unsafe conditions, access issues, and circumstances outside either party’s reasonable control may be handled separately from ordinary cancellations.

13. Client Review of Delivered Media

Clients should review delivered media promptly and notify Seaside Imagery of any technical issue, missing deliverable, or reasonable correction request within a reasonable period after delivery.

Requests for substantial changes outside the agreed scope of editing may be subject to additional fees.

14. Website Content

The content on this website is provided for general informational purposes.

We make reasonable efforts to keep website information accurate and current, but we do not guarantee that all information, pricing, availability, descriptions, images, or other website content will always be complete, current, or error-free.

We may update or change website content and services at any time.

15. Intellectual Property

All website content belonging to Seaside Imagery, including logos, branding, text, graphics, photographs, videos, designs, and other original materials, is protected by applicable intellectual property laws.

You may not reproduce, copy, modify, distribute, sell, or commercially exploit our website content without prior written permission, except where permitted by law.

16. Prohibited Website Use

You agree not to use the website to:

  • Violate any applicable law or regulation
  • Attempt to gain unauthorized access to our website or systems
  • Interfere with website operation or security
  • Upload malicious code or harmful material
  • Scrape, copy, or reproduce website content for unauthorized commercial purposes
  • Impersonate another person or entity
  • Submit fraudulent or misleading information

17. Limitation of Liability

To the maximum extent permitted by applicable law, Seaside Imagery will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to the use of our website or services.

Our liability, if any, relating to a particular service will be limited to the amount paid for the specific service giving rise to the claim, except where a greater amount is required by applicable law.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

18. Force Majeure

Seaside Imagery will not be responsible for delays or failure to perform caused by circumstances beyond our reasonable control, including severe weather, natural disasters, accidents, equipment failure, internet or technology outages, governmental restrictions, emergencies, illness, transportation issues, or other unforeseen circumstances.

When reasonably possible, we will work with the client to reschedule affected services.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Seaside Imagery and its owners, employees, contractors, and service providers from claims, losses, liabilities, damages, and expenses arising from your violation of these Terms, your unauthorized use of our services or media, or your failure to obtain necessary permissions or authorizations for a property.

20. Governing Law

These Terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute arising from these Terms or our services will be subject to the applicable courts and jurisdiction permitted under Florida law.

21. Changes to These Terms

We may update these Terms from time to time.

Any updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of our website or services after an update may constitute acceptance of the revised Terms to the extent permitted by law.
